Terms of Service

These Terms govern access to and use of the DialerHosting360 call-routing, CRM, telephony, lead-management, reporting, recording, API, and related services.

Important: Please review these Terms carefully. They include provisions concerning account suspension, fraud, telemarketing compliance, call recording, payment obligations, indemnification, liability limitations, data loss, and dispute resolution.

These Terms of Service (“Terms” or “Agreement”) form a legally binding agreement between DialerHosting360 (“DialerHosting360,” “Company,” “we,” “us,” or “our”) and the individual or organization creating an account, purchasing services, accessing the Platform, or otherwise using the Services (“Customer,” “User,” “you,” or “your”).

These Terms govern your access to and use of our websites, dashboards, call-routing systems, CRM tools, telephone numbers, call tracking, call recordings, reporting, analytics, lead-routing services, APIs, webhooks, messaging services, integrations, technical support, and related products and services (collectively, the “Service” or “Platform”).

By creating an account, accepting a quotation, paying an invoice, depositing funds, clicking an acceptance checkbox, or using any part of the Service, you confirm that you have read, understood, and agreed to these Terms.

1. Definitions

1.1 Account

“Account” means the customer profile, dashboard, credentials, balance, campaigns, integrations, routing configurations, telephone numbers, and resources associated with a User.

1.2 Affiliate or Publisher

“Affiliate” or “Publisher” means a person or organization supplying calls, leads, traffic, consumer inquiries, or campaign activity through the Platform.

1.3 Buyer or Advertiser

“Buyer” or “Advertiser” means a person or organization purchasing, receiving, answering, processing, or accepting calls, leads, or campaign traffic through the Platform.

1.4 Campaign

“Campaign” means a configuration through which calls, messages, leads, recordings, webforms, or other traffic are generated, routed, received, measured, or processed.

1.5 Consumer

“Consumer” means an individual whose telephone number, personal information, consent record, call, message, or inquiry is processed through the Service.

1.6 Customer Content

“Customer Content” means calls, messages, recordings, scripts, leads, lists, consent records, personal information, files, campaign materials, and other content submitted to or processed through the Service by or for you.

1.7 DID

“DID” means a direct inward dialing number, toll-free number, local number, tracking number, or other telecommunications number made available through the Service.

1.8 Related Account

“Related Account” means an account reasonably connected to another account through ownership, management, payment method, beneficial owner, company, domain, telephone number, IP address, device, address, employee, agent, or other identifying information.

1.9 Service Fees

“Service Fees” includes subscription fees, usage charges, call charges, DID charges, messaging fees, integration fees, carrier surcharges, taxes, penalties, compliance fees, and other amounts payable for the Service.

2. Eligibility and Authority

2.1 Minimum Age

You must be at least eighteen years old and legally capable of entering a binding agreement.

2.2 Business Authority

When using the Service for an organization, you represent that you have authority to accept these Terms and bind that organization.

2.3 Accurate Information

You must provide accurate, current, and complete identity, company, contact, billing, ownership, and intended-use information. You must promptly update it when it changes.

2.4 Verification

We may require identity, business, payment, traffic-source, campaign, consent-process, address, or beneficial-ownership verification. We may refuse, limit, suspend, or terminate access when verification is incomplete, inconsistent, misleading, or unsatisfactory.

3. Account Security

You are responsible for protecting usernames, passwords, API keys, SIP credentials, authentication codes, and all other Account credentials.

You must not:

  • share credentials with unauthorized persons;
  • sell, rent, or transfer an Account;
  • bypass authentication or access restrictions;
  • access another person’s Account without authorization; or
  • allow unrelated third parties to use your Account without our written permission.

You are responsible for all activity conducted through your Account by your employees, contractors, publishers, buyers, developers, agents, or other authorized users.

You must immediately notify us at support@dialerhosting360.com if you know or suspect that your Account or credentials have been compromised.

4. Limited Platform Access

Subject to these Terms and payment of all applicable fees, DialerHosting360 grants you a limited, revocable, non-exclusive, non-transferable right to use the Platform for lawful internal business activities.

DialerHosting360 and its licensors retain all rights in the Platform, including its source code, databases, routing logic, designs, reports, documentation, algorithms, trademarks, software, APIs, workflows, and proprietary technology.

Without prior written authorization, you may not:

  • resell, sublicense, white-label, copy, or commercially distribute the Platform;
  • use the Platform to build a competing service;
  • reverse engineer, decompile, disassemble, or derive source code;
  • scrape Platform information except through an authorized API;
  • bypass security, billing, usage, campaign, or rate restrictions;
  • remove ownership or trademark notices; or
  • interfere with or overload the Service.

5. Platform Availability and Changes

The Service may be interrupted by maintenance, telecommunications failures, carrier outages, hosting failures, software updates, cyberattacks, regulatory action, upstream changes, or events outside our reasonable control.

We may add, remove, replace, limit, modify, discontinue, or suspend any feature, integration, API, report, routing option, dashboard, or other part of the Service. We do not guarantee continuous or uninterrupted availability.

6. Customer Content and Responsibility

As between you and DialerHosting360, you retain ownership of Customer Content. You grant us a non-exclusive, worldwide, royalty-free license to host, process, route, transmit, store, review, redact, and use Customer Content as reasonably necessary to provide and protect the Service, investigate complaints, comply with law, respond to carriers, and enforce these Terms.

You represent and warrant that:

  • you have all rights required to submit and process Customer Content;
  • your content and campaigns comply with law;
  • all consent information is genuine and verifiable;
  • campaign claims, scripts, and offers are truthful;
  • your content does not infringe another party’s rights; and
  • your collection and use of personal information is lawful.

You may not process content that promotes fraud, impersonation, identity theft, unlawful discrimination, malicious software, intellectual-property infringement, prohibited products, or conduct creating material legal, security, carrier, financial, or reputational risk.

7. Telemarketing, Calling and Messaging Compliance

7.1 Customer Responsibility

DialerHosting360 provides technology and routing tools and does not provide legal advice. You are solely responsible for complying with every law, regulation, registry, carrier rule, and industry standard applicable to your campaigns.

This may include:

  • the Telephone Consumer Protection Act and FCC rules;
  • the Telemarketing Sales Rule and FTC requirements;
  • national and state Do-Not-Call requirements;
  • state telemarketing, privacy, and call-recording laws;
  • CAN-SPAM requirements;
  • A2P 10DLC and toll-free messaging verification requirements;
  • STIR/SHAKEN and caller-ID authentication requirements;
  • robocall mitigation and carrier acceptable-use policies; and
  • all applicable international requirements.

7.2 Consumer Consent

Before making or causing any call or message, you must obtain all legally required consent. Consent must be clear, genuine, applicable to the relevant caller or seller, supported by verifiable evidence, and sufficient for the communication technology used.

7.3 Consent Records

You must retain complete consent records for at least five years, or longer when required. Records should include the consumer’s name, telephone number, date and time, source URL, IP address, consent language, submitted form information, campaign identifier, seller information, certificate information, and revocation history.

7.4 External Storage

The Platform is not your exclusive long-term compliance repository. You must regularly export and independently store consent evidence, recordings, call logs, routing information, suppression records, and related documentation.

7.5 Do-Not-Call and Opt-Out Compliance

You must:

  • scrub lists against applicable Do-Not-Call registries;
  • maintain an internal suppression list;
  • honor verbal and written Do-Not-Call requests;
  • immediately process SMS opt-out keywords such as “STOP”;
  • apply suppression requests across relevant campaigns and vendors; and
  • avoid further contact after consent is revoked.

7.6 Caller Identification

You may not spoof caller ID, falsify SIP information, impersonate another company, display a number you are not authorized to use, manipulate call authentication, or rotate numbers to evade spam labels, blocking, or compliance controls.

7.7 Call Recording

You are responsible for providing all notices and obtaining all consent legally required before recording, monitoring, transcribing, or analyzing calls.

7.8 A2P Messaging

Before sending application-to-person SMS or MMS traffic, you must complete every required brand registration, campaign registration, toll-free verification, sender verification, consent disclosure, opt-out mechanism, and carrier approval.

7.9 Sensitive Information and Emergency Services

Unless separately approved in writing, you may not process protected health information through the Platform. The Service may not be used to contact, imitate, operate, or replace emergency services such as 911 or E911.

8. Zero-Tolerance Fraud, Scam and Abuse Policy

8.1 Prohibited Conduct

You may not use the Service or relationships created through the Service to:

  • defraud another person or company;
  • receive calls or leads without paying amounts validly owed;
  • knowingly withhold publisher, affiliate, or vendor payments;
  • submit fake, duplicate, altered, or manipulated leads;
  • fabricate call durations, conversions, recordings, or dispositions;
  • falsify consent records or payment information;
  • conduct chargeback fraud or deliberately evade valid invoices;
  • create replacement Accounts to avoid suspension, debt, or restrictions;
  • misrepresent campaign payouts, caps, terms, or quality requirements;
  • resell exclusive traffic to unauthorized parties;
  • steal or misuse another user’s data;
  • redirect calls without authorization;
  • manipulate traffic to obtain improper payouts; or
  • engage in conduct reasonably considered dishonest, abusive, or harmful.

8.2 Conduct Outside the Platform

We may take action based on off-Platform conduct when it involves another DialerHosting360 user, arises from a relationship created through the Service, concerns calls, leads, payments, invoices, or campaigns handled through the Service, or creates legal, financial, carrier, security, or reputational risk.

8.3 Investigations

A credible complaint involving suspected fraud, non-payment, identity misuse, campaign manipulation, or abuse may result in immediate investigation and temporary restriction.

During an investigation, we may:

  • suspend or restrict the Account;
  • stop call, lead, or message routing;
  • disable campaigns and dashboard access;
  • preserve logs, recordings, and related evidence;
  • require contracts, invoices, messages, consent records, or payment records;
  • contact relevant users, carriers, processors, or authorities;
  • freeze credits or payouts administered through the Platform; and
  • restrict Related Accounts.

A temporary suspension during an investigation is not necessarily a final legal finding.

8.4 Internal Restricted-Party List

When we reasonably determine that a person or organization engaged in fraud, abuse, repeated non-payment, serious policy violations, or conduct presenting unacceptable risk, we may place the party and Related Accounts on an internal restricted-party list and refuse future service.

Restrictions may be associated with the individual, business entity, owners, directors, payment methods, email addresses, telephone numbers, domains, IP addresses, devices, and other identifiers reasonably connected to the conduct.

8.5 No Obligation to Resolve Private Disputes

DialerHosting360 is not a court, escrow provider, debt collector, collection agency, or guarantor of private commercial agreements. We are not required to recover funds, enforce private payout agreements, compensate a victim, guarantee payment, or decide the legal merits of every buyer-publisher dispute.

8.6 Information Sharing

Where lawful and reasonably necessary, we may provide relevant information to carriers, payment processors, fraud-prevention providers, affected users, legal counsel, regulators, courts, law-enforcement authorities, traceback organizations, registries, or other parties involved in investigating or preventing unlawful activity.

8.7 Cooperation and Appeals

You must cooperate with investigations and provide requested information by the stated deadline. Failure to cooperate is an independent ground for suspension or termination. A user may submit a written appeal to support@dialerhosting360.com within ten calendar days, together with all supporting evidence.

9. Buyer, Publisher and Affiliate Relationships

Buyers, publishers, advertisers, affiliates, agencies, and call centers are independent parties. DialerHosting360 does not become a partner, employer, agent, joint venturer, escrow provider, debt guarantor, or payment guarantor by providing the Platform.

Users are responsible for independently agreeing on:

  • payouts, billable durations, and conversion requirements;
  • duplicate periods and quality standards;
  • accepted locations, caps, hours, and refunds;
  • payment dates, reconciliation, and exclusivity;
  • compliance evidence and documentation; and
  • their own dispute process.

A call or lead being routed, recorded, marked converted, or shown in a report does not by itself establish that payment is legally owed. DialerHosting360 does not guarantee consumer intent, lead accuracy, quality, duration, conversion, profitability, buyer availability, publisher performance, or payment by another user.

Billing or reporting disputes must be submitted within seven calendar days after the relevant report, call, invoice, or billing cycle becomes available.

10. Telephone Numbers and Telephony Assets

DIDs, toll-free numbers, local numbers, SIP routes, and other telephony assets are temporarily licensed and are not sold to you unless expressly agreed in writing.

We may release, reclaim, replace, suspend, or reassign a number when:

  • fees are unpaid or the Account is suspended or cancelled;
  • a carrier requires release;
  • the number is used unlawfully or generates complaints;
  • verification is incomplete;
  • the number remains inactive; or
  • continued assignment creates unacceptable risk.

Porting is subject to carrier approval, cleared balances, identity verification, required documentation, processing times, fees, and applicable restrictions. We do not guarantee successful or timely porting or that a number will be free from prior reputation issues, spam labels, or historical use.

11. Service Fees and Billing

11.1 Payment Obligation

You agree to pay all fees displayed in your plan, quotation, order form, invoice, campaign agreement, dashboard, pricing page, or other written agreement.

11.2 Currency and Prepaid Balances

Unless otherwise stated, fees are charged in U.S. dollars. Certain Services operate on a prepaid balance, and you must maintain sufficient cleared funds to cover usage.

11.3 Minimum Recharge

A minimum recharge or deposit amount may apply. Payments below the applicable minimum may be rejected, returned, held pending additional payment, or left unapplied until the minimum is satisfied.

11.4 Usage and Monthly Commitments

Usage may be billed according to call duration, billing increments, call attempts, connected calls, DID rental, messages, recordings, storage, transcription, API activity, CRM access, integrations, support, or campaign management.

Plans may include a monthly minimum usage commitment. Unless a written agreement states otherwise, the minimum remains payable even when actual usage is lower.

11.5 Taxes, Surcharges and Penalties

You are responsible for taxes, regulatory fees, carrier surcharges, numbering fees, messaging-registration fees, traceback fees, compliance penalties, processing charges, and similar costs arising from your use or traffic.

11.6 Credit

Any credit line, negative-balance allowance, or postpaid arrangement is discretionary. Previous approval does not create a right to future credit. We may consider Account age, payment history, verification, usage, security deposit, and risk, and may withdraw credit at any time.

11.7 Invoices and Disputes

Invoices are due on the date shown. A good-faith billing dispute must be submitted within seven calendar days. Undisputed amounts remain payable.

11.8 Failed Payments and Chargebacks

You are responsible for failed-payment, reversal, and chargeback costs. An unjustified or fraudulent chargeback may result in immediate suspension, termination, collection costs, restrictions on Related Accounts, and placement on our internal restricted-party list.

11.9 Refunds

Except where required by law or approved in writing, setup fees, subscription fees, used balances, DID rental fees, carrier charges, compliance fees, and promotional credits are non-refundable. Any approved refund may be reduced by usage, taxes, processing costs, chargebacks, promotions, penalties, and outstanding amounts.

11.10 Setoff

To the extent permitted by law, we may apply balances, deposits, credits, or amounts otherwise payable to you against fees, chargebacks, penalties, damages, or other amounts you owe.

12. Suspension for Low Balance or Non-Payment

The Platform may automatically suspend calls, routing, campaigns, CRM access, telephone numbers, or the entire Account when:

  • the available balance is exhausted;
  • the Account reaches its configured suspension threshold;
  • a monthly commitment or invoice is unpaid;
  • a payment fails or is reversed; or
  • continued usage would create additional unpaid charges.

An Account may be automatically or manually reactivated after sufficient cleared funds are received and all compliance or verification requirements are satisfied.

DID rental, subscription, storage, carrier, and other recurring charges may continue during a temporary suspension unless the Account is formally cancelled and the assets are released.

13. Cancellation

You may request cancellation through the dashboard or by contacting support@dialerhosting360.com. Requests may require up to three calendar days to process.

Unless otherwise agreed in writing, cancellation becomes effective at the end of the current paid subscription or commitment period. Cancellation does not eliminate liability for prior usage, outstanding invoices, carrier charges received later, regulatory fees, commitments, chargebacks, rented-number charges, or other accrued obligations.

After cancellation, you may lose access to the dashboard, recordings, call logs, leads, reports, campaigns, telephone numbers, APIs, consent records, and other Account data. You must export required information before cancellation becomes effective.

14. Data, Recordings and Retention

You are responsible for configuring recording settings, retention periods, deletion schedules, user access, exports, integrations, webhooks, and privacy controls.

The Platform is not guaranteed to retain information permanently. Data may be deleted because of Account settings, storage limits, inactivity, cancellation, non-payment, privacy requirements, legal obligations, security incidents, carrier restrictions, maintenance, or termination.

You must independently back up recordings, call logs, invoices, consent evidence, suppression lists, lead records, routing reports, payment records, and other compliance information.

We may redact, obscure, aggregate, or delete personal information after a configured or default retention period. We may preserve data longer when reasonably necessary for litigation, regulatory inquiries, fraud investigations, carrier requests, subpoenas, legal holds, or enforcement.

15. Privacy and Security

Use of the Service is also governed by the DialerHosting360 Privacy Policy. You must maintain your own legally compliant privacy policy and provide all required notices concerning call recording, cookies, tracking, lead sharing, retention, marketing, third-party recipients, and consumer rights.

When using SMS or MMS, your privacy policy must clearly explain how mobile numbers, SMS consent, and opt-in records are handled and must include all disclosures required by applicable messaging rules and carrier policies.

You must use reasonable security safeguards, including strong passwords, access controls, appropriate encryption, endpoint protection, user-access reviews, and incident-response procedures. No cloud, internet, or telecommunications service can be guaranteed completely secure.

16. Monitoring and Enforcement

We may monitor usage, routing patterns, message traffic, call activity, Account behavior, complaints, recordings, security logs, and related information for compliance, fraud prevention, billing, troubleshooting, quality assurance, network protection, carrier requirements, and enforcement.

We may review, reject, block, quarantine, modify, or remove Customer Content or campaigns that may violate these Terms or create risk.

You must promptly provide requested information concerning consent, traffic sources, scripts, landing pages, caller identity, lead origin, buyer or publisher relationships, company registration, payments, complaints, and legal compliance.

You must cooperate with traceback requests. We may immediately restrict traffic when directed, requested, or recommended by a carrier, regulator, court, law-enforcement authority, traceback organization, or registry administrator.

17. Suspension and Termination

To the fullest extent permitted by law, DialerHosting360 may immediately suspend, restrict, disable, or terminate an Account or feature, with or without advance notice, when:

  1. you violate these Terms or applicable law;
  2. fees are unpaid or your balance is insufficient;
  3. a payment is reversed or verification cannot be completed;
  4. you provide inaccurate or misleading information;
  5. your traffic generates serious complaints or appears unlawful;
  6. you fail to produce consent records;
  7. a carrier, regulator, registry, or authority requests action;
  8. your activity threatens security or network integrity;
  9. you engage in fraud, scams, non-payment, or abusive conduct;
  10. you fail to cooperate with an investigation;
  11. your conduct harms another user;
  12. your Account creates unacceptable legal, financial, or reputational risk;
  13. a required third-party service becomes unavailable; or
  14. continued service is no longer commercially or technically reasonable.

We may also investigate or restrict Related Accounts. Upon termination, calling, routing, messaging, dashboards, integrations, telephone numbers, recordings, and data access may end immediately, and all outstanding fees become due.

To the fullest extent permitted by law, DialerHosting360 is not liable for losses arising from a suspension or termination authorized by these Terms.

18. Third-Party Services

The Platform may integrate with carriers, dialers, CRMs, payment processors, consent-certificate providers, compliance databases, analytics services, registries, and cloud providers.

Third-party services may be governed by separate terms. DialerHosting360 does not control and is not responsible for their availability, security, data processing, pricing, errors, policy changes, API changes, suspension decisions, or data loss.

By enabling an integration, you authorize DialerHosting360 to exchange relevant information with that provider as necessary to operate the integration.

19. Intellectual Property Complaints

You may not use the Service to infringe copyrights, trademarks, patents, trade secrets, publicity rights, or other proprietary rights.

Complaints should be sent to support@dialerhosting360.com and should identify the protected work, the allegedly infringing material, its location, the complainant’s contact information, a good-faith statement, proof of authority, and a physical or electronic signature.

We may suspend or terminate repeat infringers.

20. Confidentiality

Each party may receive non-public information concerning the other party’s business, customers, campaigns, technology, pricing, operations, or integrations. The receiving party must use reasonable care to protect such information and may use it only for purposes connected to the Service.

Confidential information does not include information already lawfully known, independently developed, lawfully received from another source, made public without breach, or required to be disclosed by law.

21. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless DialerHosting360, its owners, officers, employees, contractors, affiliates, licensors, carriers, agents, successors, and assigns from claims, investigations, liabilities, penalties, settlements, damages, costs, and reasonable legal fees arising from or relating to:

  • your use of the Service or Customer Content;
  • your calls, messages, leads, campaigns, or recordings;
  • your violation of these Terms or applicable law;
  • failure to obtain valid consent or honor an opt-out;
  • unlawful recording or misleading caller identification;
  • fraud, scams, non-payment, or infringement;
  • your employees, contractors, vendors, publishers, buyers, or agents;
  • regulatory or carrier investigations concerning your traffic; and
  • penalties or losses caused by your activity.

We may assume control of the defense of a claim at your expense. You must cooperate and may not settle a claim affecting DialerHosting360 without our prior written approval.

22. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” DialerHosting360 disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, reliability, and error-free operation.

We do not warrant that:

  • the Service will be uninterrupted or error-free;
  • every call will connect or every message will be delivered;
  • every recording or report will remain available;
  • a telephone number will avoid spam labeling or blocking;
  • any campaign will comply with law;
  • any lead will convert or generate revenue;
  • another user will make payment;
  • third-party integrations will continue working; or
  • data will never be lost.

23. Limitation of Liability

To the fullest extent permitted by law, DialerHosting360 and its owners, employees, affiliates, contractors, carriers, licensors, and agents will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages; lost profits, revenue, customers, goodwill, business opportunities, data, recordings, telephone numbers, or replacement-service costs; or business interruption.

DialerHosting360 is not liable for disputes among buyers, publishers, advertisers, affiliates, agencies, call centers, consumers, or other third parties, including disputes involving payment, lead quality, call quality, duplicates, conversions, refunds, campaign caps, exclusivity, compliance, or performance.

To the fullest extent permitted by law, DialerHosting360’s total cumulative liability arising from or relating to the Service will not exceed the total Service Fees actually paid by you to DialerHosting360 during the three months immediately preceding the event giving rise to the claim.

24. Force Majeure

DialerHosting360 is not liable for delay, interruption, or failure caused by events outside its reasonable control, including carrier outages, internet or hosting failures, power failures, cyberattacks, denial-of-service attacks, natural disasters, war, terrorism, civil unrest, epidemics, government action, regulatory changes, sanctions, shortages, or failure of essential third-party services.

Force majeure does not excuse your obligation to pay amounts already owed.

25. Dispute Resolution

25.1 Informal Resolution

Before filing formal proceedings, a party must send written notice describing the dispute, relevant facts, supporting records, and requested remedy. The parties will attempt in good faith to resolve the matter for thirty days.

25.2 Governing Law and Venue

25.3 Claim Deadline

To the extent permitted by law, a claim arising from the Service must be initiated within one year after the claimant knew or reasonably should have known of the event giving rise to the claim.

26.1 Notices to Users

We may send legal, billing, security, or operational notices through Account email, dashboard notifications, support tickets, invoices, website notices, or other electronic communications. You are responsible for maintaining accurate contact information.

27. Changes to These Terms

DialerHosting360 may modify these Terms. Updated Terms may be posted on the website or communicated through email or the dashboard. For material changes, we will use reasonable efforts to provide advance notice where required by law.

Your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree, you must discontinue use and cancel your Account.

28. Miscellaneous

28.1 Entire Agreement

These Terms, the Privacy Policy, accepted quotations, order forms, campaign agreements, and incorporated policies constitute the entire agreement concerning the Service.

28.2 Order of Priority

If documents conflict, a separately signed agreement controls first, followed by an accepted order form or quotation, these Terms, incorporated policies, and then dashboard documentation, unless expressly stated otherwise.

28.3 Assignment

You may not assign these Terms or transfer your Account without our prior written consent. We may assign these Terms as part of a merger, restructuring, financing, sale of assets, or transfer to an affiliate or successor.

28.4 Severability and Waiver

If a provision is held invalid or unenforceable, the remaining provisions continue in effect. Failure to enforce a provision does not waive the right to enforce it later.

28.5 No Partnership

These Terms do not create a partnership, franchise, employment, agency, fiduciary, escrow, or joint-venture relationship.

28.6 Electronic Acceptance

Electronic acceptance, click-through consent, payment, digital signatures, and continued use may have the same legal effect as a handwritten signature to the extent permitted by law.

28.7 Survival

Provisions concerning fees, fraud investigations, data, intellectual property, confidentiality, indemnification, warranty disclaimers, liability limitations, dispute resolution, and other provisions intended by their nature to continue will survive termination.

29. Customer Acknowledgment

By creating an Account, making a payment, or using DialerHosting360, you acknowledge that:

  1. DialerHosting360 is a technology and communications-routing platform;
  2. you are responsible for the legality of your calls, messages, leads, and campaigns;
  3. you must maintain valid consent, suppression, and compliance records;
  4. your Account may be suspended or terminated for fraud, scams, non-payment, complaints, unlawful traffic, or unacceptable risk;
  5. DialerHosting360 may internally restrict you and Related Accounts from future service;
  6. DialerHosting360 does not guarantee payment, lead quality, conversions, revenue, or continuous Service;
  7. you must export important data before cancellation or termination; and
  8. you agree to all provisions of these Terms.
